In an unusual early retirement longtime Executive VP and CFO Doug Scovanner will retire in March, just the latest in a string of high-level departures.

Scovanner's exit, in particular, will deprive the Minneapolis-based retailer of its de facto chief operating officer and financial brain at a time when Target faces rising costs, shrinking profit margins, and an expensive foray into Canada. With Scovanners making more than $36,000,000 in total compensation since 2007 there was no rush by employees to pass the hat and find him a going away present.

With Scovanner gone next month Tarbutt will have lost 3 top level executives in 4 months. Chief Marketing Officer Michael Francis recently departed for J.C. Penney Co. and www.Target.com President Steve Eastman left to "pursue other opportunities" after a series of embarrassing problems with the newly revamped website.

As two of the company's eight executive vice presidents, Scovanner and Francis served on Target's senior leadership team as top lieutenants to CEO Gregg Steinhafel.

Hey, Doug, smile dude, you got 36 MILLION most Tarbutt employees get $1.50 over minimum wage. Hell, if I had 36 million I wouldn't work for Tarbutt either!

The Minnesota Independent has been keeping up with the NLRB's actions regarding the Valley Stream Target union vote and reports that newly placed charges might be enough to have an administrative law judge overturn the 137-85 vote of this past June.

The firing of union organizer Tashawna Green (UFCW Local 1500) and other pro union supporters in the aftermath of the vote has dinged Target's win and may, together with other intimidation, cause a revote. However, historically, such revotes have not resulted in turnarounds for unions, so a second bite at the apple may be for nothing.

Target Cleans Out It's Pro Union Workforce

at the Valley Stream Store

Regular blog readers might recall my 6/18/11 post on this site about the below Valley Stream, NY Tarbutt store having voted 137 to 85 against unionization.

The same store is now back in the news for having decimated the ranks of those who were in favor of bringing in a union, the headline reads:

"Target Cleans Out Workforce at Valley Stream Store, turnover nearly hits 25% in 6-months"

Obviously Tarbutt is spooked at the chance that any revote might give unions a toe hold in their 1700 stores. The 1/27/12 article says in part:

"Preparing for the February 1st federal hearing on Target Corp.'s violations of the National Labor Relations Act, United Food and Commercial Workers Union (UFCW) Local . . . expressed outrage that over 20% of the workforce at Valley Stream Target has been "turned over" or replaced, cleansing the store of longtime employees seeking better working conditions from the billion-dollar company."

Like the song says: 'you need to know when to hold 'em and know when to fold 'em'. Target was ahead of the game in the June vote, but now they face serious NLRB violations for canning pro-union employees.

VALLEY STREAM, NY - The retail giant Target is under fire from all sides, for union-busting at home and labor violations overseas. The reports that have come out in the past several weeks highlight a continuum of cruelty in the global supply chain.

Though WalMart has long served as labor’s arch nemesis, United Food and Commercial Workers (UFCW) has lately zeroed in on Target as a new battlefield—with its hundreds of thousands of employees and recent expansion into the supermarket sector. Although UFCW Local 1500 recently lost a vote to unionize a branch in Valley Stream, New York, their campaign deftly exposed Target’s arsenal of intimidation and smear tactics, which ranged from anti-union websites to leaflets warning that a yes vote might ruin the company and force the store to close.

Now plastered across the blogosphere, the propaganda campaign has steeled the outrage at the company’s resistance to unions. Organizers have announced they will keep up the fight:

"Target’s honeymoon is over, the national attention from the election at Valley Stream showed the American public the type of company they really are, one who has little respect for the hard working people who make their company so successful. Target still has the opportunity to change, and they should start by respecting their employees."

The cost to Target was probably $250,000, my cost was $0. Five years after this, and other blogs, went up they are still alive and functioning and not one word has ever been deleted or changed due to outside pressure.

This civil action started on Sept. 5 of 2006

and dragged on until July 16, 2008.

Target Corp. is tired of being used as a Showroom for Internet shoppers

Tarbutt is annoyed that their 'guests' are being 'pests' and are coming in to their stores to take a look at products they sell but these items are also being offered for sale online, almost always at a lower price.

Target is now 'asking' (really telling) their suppliers that they want help to stop this 'showrooming', and they want that help to be in the form of their suppliers creating special products that they and other stores would carry which would not be available other that at their stores.

This would make consumers going into T. to price check items useless as T would have products (particularly electronics) that were unique to T and other participating brick and mortar stores.

As pointed out in a long WSJ article (see: http://tinyurl.com/75zqul9 by Ann Zimmerman) "Some analysts said Target's new tactics are unlikely to reverse the showrooming trend, because they fail to address the root problems traditional retailers face. Online-only retailers have significantly lower labor costs and, at least, for the time being don't collect sales tax in most states."

Target may be the 2nd largest retailer but they are starting to feel the heat from consumers that are willing to take their business to the cheaper online web sites. This is just another example of Target being consumer unfriendly and another reason that "TARGET SUCKS!"

Changes in Target Health Care starting next week!

Next week there will be some changes announced for Target Health Care and team members will be briefed on them.

In summary the changes are as follows:
1. If you are currently enrolled in the HMO or PPO, you can re-enroll in it for 2012. You will not automatically be enrolled in any plan this year.
2. If you are not currently in the HMO or PPO, you do not have the option to enroll for it.
3. Both the HMO and PPO are being discontinued and will not be available in 2013. The only options are the savings-account based HSA and HRA.
At the same time, target will be instituting a $5 per week surcharge for smokers. (this will be in the form of a $260/year surcharge for any medical plan, including HSA/HRA).

Example FYI:

3. A TOBACCO SURCHARGE WILL BE INTRODUCED.
Because tobacco use increases health care costs, you will pay an annual surcharge of $260, which equates to $5 per week, if you or any of your enrolled dependents use tobacco products.

During 2012 Open Enrollment, you will be asked to state whether you or any of your covered dependents have used tobacco products in the past six months. If you do not complete this step, you will be charged the $260 tobacco surcharge.
There are two ways to end the tobacco surcharge:
1) After six months of being tobacco free, call the Target Benefits Center to have the surcharge removed,
OR
2) Complete the free ‘Quit Plan’ tobacco cessation program and call the Target Benefits Cengter to have the surcharge removed.

FRIENDSWOOD, Texas—Mothers from around the country plan to support a Friendswood mom who says she was harassed at a Target store for breastfeeding. More than 100 different “nurse-ins” are planned in 35 states after hearing about the case of Michelle Hickman.

Hickman and her then 4-month-old son Noah were visiting the Target in Webster last month when he started getting hungry. “I was taking care of my baby’s needs,” said Hickman. “I was bothered by people wanting to make a spectacle of it.”

Not the customers, she said, but the employees. “They all came in and started walking and looking like I did something horrible,” said Hickman.

The first employee reportedly suggested that she use the fitting room. Another supposedly told her that she could be cited for indecent exposure. I had this big blanket over me,” Hickman said as she showed KHOU 11 News.

After feeding her child, Hickman left the store and later called the corporate office. She said she was told by guest relations, “just because it’s a woman’s legal right to nurse a baby in public doesn’t mean she should walk around the store flaunting it.”

KHOU 11 News contacted Target and they sent a written statement claiming that “guests who choose to breastfeed in public areas of the store are welcome to do so without being made to feel uncomfortable.”

The statement went on to say that “Target has been in touch with the store to ensure all team members are aware of our breastfeeding policy.” Hickman was so angry about what happened, she shared her story online and with a mother’s groups.

That’s where the idea of staging a “nurse-in” was born. The nationwide “nurse-in” is scheduled for Wednesday, December 28 at 10 a.m.

Editorial Comment: If any retail chain is taking lumps for stupidity there is an 85% chance that it is going to be Target. This is my 6th year in reporting just how badly Target Sucks and there is simply no end to stories about this disfunctional chain.

Now it is breastfeeding, 2 weeks ago it was refusing to let 25 kids shop for a charity in their Mayfield Heights Ohio Store. It is always something with this bunch of incompetents. Eventually I will get old (older) and die, but Target will always Suck.

An Open Letter to Target’s Mayfield Heights Store

Dear Sir or Madam:

For the past five years, three colleagues and I have taken a group of approximately 25 6th, 7th, and 8th grade students—part of our award-winning student council group—on a philanthropic experience that, for these students, often changes their point of view on life. You see, many of them come from homes where they do not want for much of anything

This experience of which I speak benefits one such worthy organization, a place known as Providence House. Providence House (PH) is a Cleveland-area crisis nursery. They help children ages newborn to six at risk for imminent abuse or neglect. Often, these children come from homes with terminally ill parents, parents with drug problems, or homes where money is scarce the homelessness hangs over their heads. Some have never had a birthday party.

What is this “trip”? Well, each December, right before Christmas, the council learns about Providence House. Then, they work to collect money for PH through a variety of school activities. They generally raise somewhere in the neighborhood of about $2000. We then take this select group to our local Mayfield Heights Target store, where they shop in small groups for items PH needs.

Ok, so back to the customer service and community relations issue.

As a courtesy, I phoned Target to let them know we would be coming, as we have done the week of our visit in years past.

The conversation was quick. I spoke with a woman named Shelly. She was rude and did not mince words. I identified myself as Sandy Bean, with Mayfield Middle School, and explained that we would be bringing a small group in on Friday for our annual Providence House shopping trip. I explained that we would once again need a lane opened for our purchases, and I wanted to know what else they would need from us. Of our purchase order charge account was in order, etc. The conversation went something like this.

“Well, you can’t come in. The schedule is made and I just don’t have the cashiers. I need at least two weeks’ notice. Sorry,” Shelly said, curtly.

“We usually spend over $2000… Would you prefer we head over to Wal-Mart?”

“Hold on.” When Shelly returned to the phone, I was told, “Nope. Sorry. We can’t accommodate you.”

I told her, “It has never been a problem in the past, and we have never given two weeks’ notice before.”

“Well, actually, it has been a problem, ma’am, because we can’t check other guests out when you’re here.” She replied, with a definite tone rising in her voice.

“So, we can’t spend our money there on Friday?”

“No.”

“Okaaayy…I suppose we will go somewhere else then. Thank you,” and I hung up.

I was completely caught off guard. I had called for a heads up, and they wouldn’t take the money that we had worked so hard to raise? That we had already deposited into our account so we could pay with our Target account set up just for this purchase? Was this the same Target that gave the kids popcorn and soda the past few years?

Let me get this straight: My organization has spent over $12,000 with you the past five years, during FIVE shopping trips. We have never called more than a week in advance. The second year, we *forgot* to call in advance. We were greeted with a smile, and we accommodated accordingly.

We arrive at about 8:45 am. The store is normally empty. We are gone before 11. It takes one lane, one cashier, and about 30 minutes for us to check out. We pay with one charge account. The students stand at the end of the lane and sort into carts, then take it out to the bus to load. How does this stop other patrons from paying? Come on. I’ve worked in retail.

• For five years running, we have never gotten a call or a letter from the Target store to discuss any problems with the students, the check out process, or anything else related to the trip (we have written thank you notes every year, mind you, and our names and address are clearly written on the letter). If there were ever any issues, we did not know about them and could not rectify anything.

• This year, I call Shelly, and rudely and in no uncertain terms, she tells me that our money is *not* good there? And that we are a problem and should go somewhere else? My 24 student leaders are more of a problem than the general populace, pouring in and out of there each day?

You have got to be kidding me. I am appalled. I have no desire to take my money, the council’s money, or anyone’s money to this store ever again. We plan to go to another store, and continue to go to another store for as long as this project exists. I may be one person, but I am a person who gets to make a lot of fundraising decisions, and who gets to bend the ear of many parents and city leaders, who respect and value my opinion. You can bet I’ll be telling everyone who will listen that Mayfield Middle School Student Council’s charity money is no good at Mayfield Heights Target without two weeks’ notice, and that our students had to take their work for Providence House elsewhere.

I immediately went to the internet and researched this. CAPE CORAL - The Salvation Army's red kettles are banned at Target and that has some residents seeing red. "This is an insidious and ridiculous attack on people who need help," said Cape Coral resident Dick Kalfus. "It's absolutely frightful."

The Salvation Army collects money for needy families and buys toys for kids at Christmas. But Target's corporate office sees that as soliciting, which the company doesn't allow. "They've insulted all people in southwest Florida that rely on the Salvation Army for help," said Kalfus. "I think it's a stupid decision."

But Target's corporate office sees that as soliciting, which the company doesn't allow.Spokesperson Jessica Carlson said: "We do not permit solicitation or petitioning at our stores regardless of the cause or issue being represented." Carlson says the company's no-solicitation policy "does not diminish" their support for the Salvation Army.

A Salvation Army spokesperson says they are grateful for stores that do allow bell ringers this time of year.

Still, the ban isn't sitting well with Kalfus, who is calling for a boycott of the retail giant. "They've insulted all people in southwest Florida that rely on the Salvation Army for help," said Kalfus. "I think it's a stupid decision. Target doesn't owe me an apology," said Kalfus. "But they certainly owe an apology to the people who have been depending on the Salvation Army, a magnificent organization, to help them." "Hopefully they will see the light," he said.

Target Manager Fired For Working Through Lunch

Jason Kellner worked at the Target store in Oxford, Alabama as a Senior Team Leader and sometimes Leader on Duty for 8 years until firing 9/13/2011. His ending rate of pay was $20.37 per hour.

Plaintiff and other STLs had complained at meetings about not getting uninterrupted 30 minute meal breaks. Shortly after that Defendant Target terminated him for working during his 30 minute breaks which is contrary to Target policy, ie: "performing work activities" without being clocked in”.

Plaintiff disputes that and files in Federal Court claiming he was fired in retaliation for his initial complaints

It's not that Target's executive leadership has a problem with the gays -- they just wish they wouldn't stand so close to them. The retail giants lawsuit to get gay-rights activists to stop standing on the sidewalk near the front doors of several of its California locations got denied.

California Superior Court Judge Jeffrey Barton rejected Target's request for an injunction against the activists, ruling that the store entrances are a public forum under California law. The corporation said it tried to gag the canvassers in order "to provide a distraction-free shopping environment."

It's not that Target has a problem with gay activists expressing themselves and participating in grass-roots democracy. It has a problem with everyone doing that.

With PR finesse like this -- to say nothing of your falling out with Lady Gaga and the whole bigot-funding crisis that got you in this mess in the first place, you're sure to have the people back on your side in no time.

Tashawna Green, 21, of Jamaica, Queens, got fired Aug. 6th from her high paying $8 hour job at Tarbutt 7 weeks after the store employees voted not to join United Food and Commercial Workers Local 1500.

An unfair labor practice charge was filed with the National Labor Relations Board, alleging Ms. Green was fired “because of her activities in support of the union.” NLRB Regional Director Alvin Blyer, said his office received the charge and is investigating. He said the labor board planned to rule soon on dozens of other unfair labor practice allegations brought both by the union and by Target. In a statement, Target said Ms. Green was fired because she “recently acted in an overly hostile, disruptive manner that is inconsistent with Target's policies.”

Local 1500 issued a formal challenge to the election, alleging workers were bribed and intimidated into voting against the union, and is seeking a rerun election. All Target stores are nonunion. There are 10 in New York City.

Here is a little oddity regarding what once was a consumer site where you could go and post reviews of any firm. It was first registered in 2004 and initially was jobvent.com and for the Target reviews: http://www.jobvent.com/target-job-reviews-C455

Target was one of the many firms with reviews. It had a flat 300 the last time I saw it and there were ‘Love It: 72, Hate It: 228’ reviews. Around 11/20/10 the site was frozen. No new reviews for any firm were being taken and they still aren’t. “We're sorry...Jobitorial is not accepting new employee reviews at this time.”

Just by chance I looked in today 9/17/11 and the internet address redirected me to http://www.jobitorial.com/target-job-reviews-C455 Now here is the odd thing, there are no more 300 reviews! Any review below giving Target a 3.1 on a 5 scale have been deleted! The new owners of the site have gone back and removed those reviews with any worthwhile criticism of Target. There are 62 reviews dated from 5/17/06 to 9/11/10.

The negative 228 Target reviews are gone and the site remains closed to new reviews but a shining beacon telling people: “Tomorrow is my last day working at Target, and I had a fantastic time working there.” And “I always enjoyed my job at Target and most of my coworkers.”

So chalk one up for Spot’s PR Department which is probably:

An update on a consumer site that sold out.
I stopped by the Job Vent site, haven't been there since July. Wow! Talk about someone 'selling out'! This site is now TOTALLY in the bag for Target. The hundreds of critical posts are gone, replaced by over 60 posts that all seem to LOVE Target. Must be that Target either bought the site or they slipped someone a good few bucks to redo the Tarbutt posts (http://tinyurl.com/2amahdj).

Now the site sounds like they had half a dozen drones at HQ make up some BS posts and back dated them to make it seem like actual T. workers were posting comments. P. T. Barnum said: "You can fool some of the people some of the time, but you can't fool someone who worked for Target - They all think the place sucked!"

Target has a whole department that deals with the Internet and both buys up names of sites (ie: Target Sucks, F Target etc) and keeps up the payments on them to keep them out of the hands of irate bloggers (like me) who would grab onto something like http://www.targetsucks.com/* in an instant. At least two anti-Target union sites went bye bye a couple of years ago, couldn't afford the site rental payments I think, so now we are not only missing this Job Vent site but it has turned into a real Kiss Ass For Target site. Unhappy returns: Woman targets Target with baseball bat

Donna Rosenberger, 39, of Cranberry, just had enough of Tarbutts crap over returns and with a baseball bat broke 6 windows out of the front doors of the Tarbutt store, 9805 McKnight Rd., Pittsburgh, PA 15237.

She tried to return 2 ice cream makers that she had purchased with a check. A clerk, offered her a gift card for the value of the items instead of cash. Police released Rosenberger on her own recognizance for a later court appearance. Good for you Donna!

We need more consumer activists willing to let this 3rd rate crappy retail chain know what their customers think of them. Here is the brief story FYI:

A disgruntled customer attacked a McCandless Target store's windows with a baseball bat around 11 this morning, police said.

According to McCandless Police Chief Gary Anderson, a female customer, incensed over Target's return policy, armed herself with a baseball bat and smashed in the store's windows before security guards managed to subdue her.

Police arrived soon after and transported the woman to a holding cell, where she awaits the filing of formal charges. Chief Anderson said she likely will be charged with criminal mischief, with additional charges possible.

A Target manager said she could not provide a damage assessment for the attack.

Former Target security agent arrested in thefts

SALEM, MA - MARCH 18

A former Target store security guard, who was let go after he was accused of being a little too rough with a shoplifter, was arrested on shoplifting charges of his own on Saturday evening. Joseph Servizio, 32, of 5 Robb Road, Beverly, and Jason Stone, 37, of 12 Grant St., Beverly, were arrested — Stone after a foot chase that led into a yard on Berrywood Lane, shortly after 6 p.m. Police had spotted the pair on Highland Avenue near Willson Street after getting a report of shoplifters at the Target store on Highland Avenue.

When the vehicle they were in finally stopped, police said, Stone bailed out of the passenger side and took off, pursued by Patrolman Fred Ryan. As it turns out, Servizio was a former store security guard at the Target in Revere, where, Salem police learned, he had been let go after “slamming” a suspected shoplifter to the floor, according to a police report.

A security officer at the Salem store knew Servizio and was also aware that he was suspected of stealing from other Target stores, police said in their report. The security officer said he knew Servizio was in the store and began watching as he signaled Stone to take a Polaroid video game system valued at $157.48 and a pink backpack worth $10.

Stone pleaded not guilty at his arraignment in Salem District Court yesterday, where he was ordered held on $2,500 cash bail. Servizio, who made bail over the weekend, is expected to appear in court today for arraignment.

NEW YORK (AP) -- Workers at a Target store in New York voted against joining the country's largest retail union Friday night.

The United Food and Commercial Workers Union Local 1500 said it would contest the results and ask the federal government to order a new election, alleging that Target illegally intimidated workers.

Both sides said the workers at Target's Valley Stream store voted 137-85 against unionization. A "yes" vote would have made the store the first of the company's 1,700 locations to bring in organized labor.

"Workers are seeing their hours getting cut and their take-home pay, while basic costs for gas and food are soaring," says Burt Flickinger III, president of retail consultancy Strategic Resource Group. "They're increasingly frustrated."

Workers at the store in Valley Stream are upset about hourly wage increases amounting to eight cents or less, says Patrick Purcell, the union spokesman. Some employees also say their hours have been cut from 30 per week to fewer than 10.

Part-timers must bank at least 20 hours a week, on average, to qualify for benefits.

Pa. woman sues over Target debt collection!

CNBC, AP and The Consumerist have picked up and reported the latest Tarbutt outrage. "AP: ' a Pa. woman sues over Target debt collection"

The basic allegation is: "A western Pennsylvania woman filed a federal lawsuit Wednesday against Target Corp. and its law firm over the discount department store chain's debt collection practices, saying false affidavits were used to go after customers who allegedly owed money to a subsidiary bank that issues the store's credit cards."

The plaintiff, Vicki Higgins is trying to obtain class action status for her suit saying that Target and their law firm, Patenaude and Felix APC (photo R), is: 'violating federal racketeering and Pennsylvania's fair credit laws.'

Ms Higgins was initially sued by Tarbutt in April 2009, but the suit was dropped five months later, however by that time she had piled up legal bills defending it and she now is suing not only to recover her costs but wants to make it a class action suit as well. False notarized affidavits alleging debts were used in Targets filing against Ms. Higgins.

Having delt with 2 of Tarbutts law firms in a 23 month suit where they tried to close down this blogsite I know what a bunch of sleeze bags they are and I hope that they get their butts kicked.

SAN DIEGO - Target Corp. is suing a San Diego pro-gay marriage group to get it to stop canvassing outside its San Diego County stores, alleging its activists are driving away customers.

Rights advocates say the trial between Target and Canvass For A Cause that begins Friday could further strain relations with the gay and lesbian community after controversy over its $150,000 donation to a business group backing a Minnesota Republican candidate opposed to gay marriage.

Minnesota-based Target insists it remains committed to the lesbian, gay, bisexual and transgender community and its lawsuit has nothing to do with the political agenda of the organization.

"Our legal action was in no way related to the cause of the organization and was done so to be consistent with our long-standing policy of providing a distraction-free shopping experience by not permitting solicitors at our stores," the company said in a statement sent to The Associated Press.

Target says it has taken similar action against a number of organizations representing a variety of causes. It alleges in the lawsuit that the San Diego group's activists harass customers by cornering them near its stores' front entrances and debating with them about their views on gay marriage.

The group says it canvasses at shopping malls, college campus and stores like Target to collect signatures and donations in support of gay marriage.

The corporation says at least eight Target stores in the area have reported receiving more than a dozen complaints daily since canvassers started working outside their stores in October 2010. Target says the activists have refused to leave when asked politely and shown the company's policy prohibiting "expressive activity" on its property.

Canvass For A Cause director Tres Watson says Target wants to silence the 12,000-member group that formed in 2009 because it promotes gay marriage.

"It's very David vs. Goliath," he said. "We understand they're the Goliath in the room. They've got all money in world to get us to stop talking about gay marriage."

Watson says volunteers are trained daily on being professional and polite and their aim is to educate the public about the rights of gays and lesbians.

He says they have a right to work outside the stores and the courts have ruled in the past that shopping centers are today's public squares where freedom of speech should be allowed.

Target Denied Preliminary Ban on Equality Group Collecting Signatures Outside Stores

Embattled corporation Target, that also saw its partnership with music star and LGBT-rights advocate Lady Gaga dissolve this week, was dealt another blow Tuesday when a San Diego judge refused Target's attorneys a motion to prevent grassroots marriage equality campaigners from gathering petition signatures outside stores in California while Target's legal case against them is heard.

Target has faced heavy criticism from LGBT rights groups after it was revealed last year that the discount store giant had donated funds to MN Forward, a group that directly supported anti-gay candidate Tom Emmer in his failed 2010 run for governor of Minnesota.

When told that Target has a no-solicitation policy, the protesters assert a right to free speech and, attorneys for Target claim, refuse to leave Target premises. Documents note that when law authorities have been called, they too have refused to remove solicitors on free speech grounds.

Court documents also suggest that those acting on behalf of Target are concerned that the chain may be perceived as being pro-gay marriage which, in turn, will cost them business, with one document saying:

"Some guests have told us that they are offended by the controversial pro-gay marriage messaging of the solicitors, and that they assume Target promotes the same view."

Target Amends Giving Policy

The big-box retailer has changed its political contribution policy in the wake of last year's uproar over its donation to a group supporting an antigay candidate.

Not even our precious and seemingly invincible Target is free from layoffs. Target Corporation announced layoffs to employees this morning at their Minneapolis headquarters, WCCO reported. Now we have the details from Target officials.
The cuts affect 9 percent of their workforce at headquarter locations. This includes about 600 layoffs and eliminating 400 open positions primarily in the Twin Cities. The majority of these changes are effective today.
Target will also close its Little Rock, Ark. distribution center later this year. The center currently employs 500 people. More details below.

Target headquarter employees responded to the layoffs, saying they were surprised by the announcement.

More from the Target announcement: "The company has recently undertaken other actions to manage expense and capital investment and minimize the number of affected employees. These actions include suspending salary increases for senior management, suspending share repurchase activity, tightening credit card underwriting and credit granting, implementing initiatives to improve store productivity, reducing planned new store openings, and cutting outside contractor support, travel, entertainment and other headquarters operating expenses.

We are clearly operating in an unprecedented economic environment that requires us to make some extremely difficult decisions to ensure Target remains competitive over the long-term," said Gregg Steinhafel, President and CEO of Target Corporation.

Headquarters employees affected by the announcement will continue to receive their full pay and benefits through April 1, after which they will receive a comprehensive separation package based on their years of service.

As part of that package, Target also will provide these employees with 12 months of continued Target health care benefits in addition to 12 months COBRA benefit, and outplacement support to assist them in transitioning to their next position. Little Rock distribution center employees will be offered positions at other Target distribution centers, or will receive comparable severance.

According to the Minneapolis-St. Paul Business Journal, "the company's same-store sales fell 4.1 percent in December, following a decline of 10.4 percent in November. In fact, the company hasn't reported a monthly same-store sales increase since last June.

I witnessed these layoffs firsthand and can tell you there was no "pack up and don't come back."

No one who delivered this tough message took any pleasure in doing so. The standard practice for terminations at Target is to bring the person to HR, give the news, and see them out the door. No one has EVER been allowed to return to their desks to say goodbye, send a few final emails, clean their resume off the network, and generally hang out for 2 hours. It was an unprecedented gesture of fairness and compassion that I have never experienced at a large company. Add the severance package and you can see that Target is trying to be fair - most large companies do not do this.
Sure, it looks to be laid off - but I've already had one of these laid off folks playfully taunt me for he package she received, the fact that she has a 2-month paid vacation while I have to return to work.

Overall there were a lot of tears, a lot of goodbye, a lot of sincere apologies from management - who didn't even know their people were being laid off. Managers just received a list of people who were being terminated this morning, and had 15 minutes to get their stuff together before the 8:45 meeting.

Rough day.

BANGALORE: India’s top tech firms (TCS, Wipro and others) are pursuing Target’s captive technology centre for a long-term outsourcing contract worth $300-400 million. Target has around 1,500 staff employed at its Bangalore centre, currently doing software development and maintenance work.

Both TCS and Wipro count Target as one of their top retail customers.

Some of the world’s top retailers have been outsourcing projects to Indian third-party service providers, including TCS and Infosys, apart from their own captive centres in order to support their existing IT systems and also develop newer applications. Outsourcing millions every year by outsourcing its IT projects to India.

“Target’s India centre could be doing at least $100 million worth of projects (revenues) every year." Officials at Target did not reply to an email query sent by the Economic Times. Target entered India in 2004 through a Joint Venture with ANSRSource, a Texas-based BPO outsourcing company.

“There is a certain equity in building up the operations (captive) initially, but over the course of time, there is the objective of monetising the operations,” said Avinash Vashistha, CEO, Tholons, an offshore advisory firm.

TCS, one of Target’s Indian suppliers, supports the retailer’s operations from its delivery centres in Uruguay and Chile, apart from India.

Target Ordered to STOP Illegal Calif. Dumping of Hazardous Waste!

In a case without much national exposure, on 9/24/10 Alameda County Superior Court Judge Steven Brick issued a preliminary injunction prohibiting Target Corporation and its employees from illegally dumping hazardous waste, using unregistered haulers to transport hazardous waste, transporting hazardous waste without the required manifests and illegally managing and disposing of waste such as batteries and other electronic equipment.

Prosecutors said tons of hazardous wastes and contaminated material were crushed along with discarded merchandise and garbage in Target's compactors and sent to area landfills.

Six months ago this suit was filed in California, but the same problem clearly exists in the other 1600+ Tarbutt stores in the other 49 states. I don't see any signs that the other Attorney Generals are moving on the problem but if California wins then perhaps it will wake up the rest of the country and some action will be taken. It really seems like a Federal violation that the EPA should be addressing, rather than 50 individual states.

"A lawsuit was filed against Target Corporation by the California Attorney General and 19 district attorneys. The suit alleges that Target's 200-plus California stores have improperly disposed of hazardous materials for the past eight years.

Target has stores handle and sell substantial volumes of hazardous materials, including bleaches, pool chlorine, pesticides, fertilizers, paints and varnishes, ignitable liquids, aerosol products, cleaning agents, automotive products and solvents and flammable and corrosive materials . . .Some of the materials spill, break, expire or become damaged such that they cannot be sold or used, according to a press release from Santa Clara County District Attorney Dolores A. Carr."

"When I got home, I noticed that the receipt showed that the cashier had only charged me for one of the sets. I did not notice if she put both under the scanner so I don't know if it is a misread or an error on the part of the cashier.

There was a woman in front of me who caused her nearly a half hour of grief over coupons and sale prices, so she was a little distracted when she got to me. I don't want her to lose her job, but I feel the need to call and tell them that I was not charged for all my items.

It is only a $20 DVD but I feel a twinge on honesty. I would love to have the opinion of your readers."

I'm going to do away with 'nominations' and just give the 'Moron of the Year' award to this guy.

Target Employee Fired Over Black Friday Trampling Incident

Now that the dust has settled Tarbutt is doing some damage control over the Buffalo Target Trampling Incident and has canned Lou Orlando, their 14 year Security Manager at the Buffalo store. He says that the reason was that the 53 second video made it to the internet and that Tarbutt is looking for a scapegoat for the incident.

Orlando said he was fired, "Because I didn't make certain phone calls in the correct amount of time. . .you make a call to corporate to call people who need to know in our district that something has happened".

However Orlando says after the incident he couldn't make calls, because he still had hundreds of customers shopping. He wanted to stay on the floor to make sure nothing else went wrong.

The local TV stations and the internet video, shows customers running over each other to be the first ones in the door and one man at the Buffalo store suffered a herniated disk after being trampled by his other shoppers. Tarbutt has agreed to take care of his medical bills.

Orlando also alleges that Target said that he didn't follow the correct procedure, using barricades to stop what he called "line crashers." He said that Target also cut funding to certain stores for paid police patrol so authorities were not on the scene...and Orlando is not trained in crowd contro l. . . so he says he made the best decision he could, with what resources he had. He concluded, "I think I did a darn good job. What more can one man do."

Target alters how it handles coupons

Cashiers told to hand-process money-saving slips after customers were shortchanged

Target Corp. in recent days has apparently issued a new store policy that requires cashiers to temporarily hand-process customer coupons, following media reports that the discounter was shortchanging its customers nationwide. It promised a permanent fix within 10 days.

The mass merchandiser, with about 1,750 U.S. stores, for months has been crediting customers for only a fraction of the face value of certain manufacturer coupons. One of the biggest problems involved coupons that require purchasing multiple items.

In a Tribune story Oct. 28 that was reprinted nationwide, a Target spokeswoman faulted the stores' scanning machines and said the company was working on a fix.

My Comment: Where is the money going for the full face value of the coupons that Target redeems with the manufacturer? A customer has an 70 Cent coupon, Tarbutt credits them 10 cents and sends the coupon back to the manufacturer for the full 70 cents + a per coupon handling fee, so where does the other 60 cents go?

Ans: Target keeps it!

Which is really their everyday policy
Without a receipt, shoppers can only return a total of $70 worth of merchandise in a 12 month period. Some electronics are subject to a 15% restocking fee.
After surpassing the $70 limit, customers can exchange items within the same merchandise department.

Holiday and seasonal merchandise on clearance at the time of return will be refunded at the current clearance price.

So folks, have a Merry Christmas and be sure and shop elsewhere, Target is just continuing their policy of assuming that anyone who returns something without a receipt stole it. So if you give granny a sweater from Tarbutt and she wants to get a different size, color, etc and has no receipt granny will be treated like a thief. Shop somewhere else!

LA Times Blasts Target for Cheating Consumers

National retailer Target Corp. for months has been shortchanging its customers who use certain manufacturers' coupons by crediting them for only a fraction of their face value.

Target is calling it a computer glitch. Avid coupon users are calling it an outrage.

"It's just a mess. It makes me not want to go there," said Caroline Jaworski, of Harwood Heights, Ill. Wednesday morning, she said, her $1.50 coupon for two packs of feminine-hygiene products was reduced by the register to $1.02 at the local Target store.

"You really have to watch the registers, and for people who don't, they don't know they're getting ripped off," Jaworski said. "I think this is a serious issue that a lot of people aren't aware of."

Stephanie Nelson, founder of CouponMom.com and author of two books on couponing, said shoppers are supposed to get discounted the full amount for multiple-item coupons. "I've never heard of this happening at any supermarket," she said.

Target says it has been aware of the problem since August.

The Minneapolis-based retailer, which operates about 1,750 stores nationwide, couldn't explain why the problem was happening or why it hadn't been resolved.

"We are aware that some coupons are not scanning for the full amounts," Target spokeswoman Erika Svingen said. "We are aware of the issue and are diligently working on a fix for that and will implement it as soon as possible."

Coupon use soared during the recession. Some 3.3 billion coupons were redeemed in 2009, a 27% increase from the year before, according to coupon research site CouponInfoNow.com.

Maybe most disconcerting to many Target shoppers is that the coupon problem has been ongoing since at least midsummer.

"I don't understand how a national company knows there's an issue but hasn't done anything about it," Jaworski said.

Target has instructed cashiers to check coupons to ensure customers are getting the full value, Svingen said.

"We apologize for any inconvenience this has caused our guests," she said. "Anyone who does not receive the full coupon amount at the register can bring their receipt to guest services for a refund of the difference."

Shoppers complained primarily about coupons that require the purchase of multiple items. Multiple-item coupons make up a quarter of all coupons, according to Inmar Inc., which helps retailers and manufacturers manage coupons

The glitch appears to stem from a common practice among retailers. Stores won't allow a coupon to reduce the price of an item to less than zero. Otherwise, it would have to pay the customer cash for buying the item. Free is the best they will do, which is also Target's stated policy.

In Target's case, the application of that rule seems to be fuzzy. Consider an example used by coupon expert and blogger Jill Cataldo, who said she's been shortchanged by Target registers eight or nine times in recent months.

"I have no vendetta personally against Target, but it's not fair at all," said Cataldo, adding that she doesn't believe the company is cheating customers intentionally. "Many coupon shoppers are savvy and watch the register like a hawk. But a casual coupon user may not realize it until they're home, or not realize it at all."

Cataldo's example concerns a recent coupon offering $1 off when buying eight containers of Yoplait yogurt. The conventional thinking is that a Target consumer would pay $1 less than the total cost of all eight packages.

But apparently Target's checkout registers, after making sure you bought eight, apply the $1 discount to a single 39-cent yogurt. The computer then apparently figures that the value cannot drop below zero, so just 39 cents is subtracted instead of $1.

Retailers typically submit for reimbursement the face value of coupons. If applied, Target would get $1 from the manufacturer, netting the retailer 61 cents.

That doesn't sound like much money, but it quickly adds up over many different items over hundreds of customers at Target stores nationwide, Cataldo said.

Target had no comment on what will happen to that money.

Kraft Foods, a major issuer of coupons, is "not aware of any issues with redeeming coupons at Target," a spokeswoman said.

3. During the 2009 time frame, I attended a weekly training that dealt with the issue of how to get the Target Team Members to wear the red shirts and khaki pants. We were trying to force Team Members to wear the red shirts and khaki pants without actually instructing them that these were “uniforms.”

4. At this meeting, Target Corporate issued written directive and a training statement that told us what we were supposed to say to Team Members in order to persuade them to wear the red shirts and khaki pants, and how to deal with any negativity from team members regarding the uniforms.

5. The statement from Target Corporate regarding the red shirts and khaki pants told us to tell team members about the importance of “being a team player” and that when they are wearing the team colors, they are showing support for the team and it helps to build team morale. The true reason for these statements was to manipulate the team members into wearing the red shirts and khaki pants by making them feel as though they were not part of the Target team if they did not cooperate with the instructions regarding clothing.

6. Pursuant to Target’s Corporate company policy, also called a Training publication, we were not allowed to actually “tell” the team members that they “had” to wear the red shirts and khaki pants, and so this training and statement was to show us how to work around that rule, which I now understand is the law. We were to do that by making team members feel as though they didn’t have the choice not to wear. . .

SAN ANTONIO -- Melissa Hettie said she came out of the Target store at Highway 281 and Bitters Road just as Tropical Storm blew through San Antonio on Sept. 7th when she said she saw it out of the corner of her eye: a light pole in the parking lot falling as if in slow motion on top of her vehicle.

"I couldn't even say that's my car," said Hettie. Yet when she filed a damage claim with the Minneapolis-based retailer after her car was declared a total loss, Hettie said it was rejected.

A Target spokeswoman said the company has been speaking with Hettie, but she could not address specific incidents and that claims are handled on a case-by-case basis.

"I actually feel rather hopeless because they were not the easiest company to deal with," Hettie said. Yet she also said she is angry and disappointed in Target where she's been a lifelong, loyal customer.

Hettie said the company that handled her claim told her Tropical Storm Hermine was to blame, not Target. Gusts were clocked at up to 64 miles an hour.

However, Hettie said the parking lot's other light poles were spared and she has photographs of the base of the pole, showing its extensive rust damage. "It was in ill-repair," she said.

Hettie said as a result, she is now without a car, without any recourse and is four months pregnant. She also said she was laid off less than a week after the incident.

I bring to your attention the interesting case of:

Marjorie Ann Diaz v. Target Corporation
CV 10-1103 AG (MLGx), now before UNITED STATES DISTRICT COURT CENTRAL DISTRICT OF CALIFORNIA and a case that is going to proceed as a class action against Target.

This case was removed from Orange County Superior Court to U.S. District Court 7/21/10. The original complaint runs 64 pages with 64 additional pages of attachments. The PACER Docket report itself runs for 9 pages. Clearly this is going to be a long case with serious implications for Target nationwide.

Target of course whines about being sued and puts forth many objections and asks for the matter to be tossed out, but as the Honorable ANDREW J. GUILFORD says: “Defendant Target Corporation’s Motion to Dismiss is DENIED as to all claims”.

Plaintiff Diaz filed a class action complaint on behalf of herself and all others similarly situated. Ms Diaz was an hourly non-exempt employee of Target in Irvine, California, from approximately October 2000 until May 2009, and alleges the following:

Yesterday, Cherie was shopping at a Target in Cincinnati when she claims she witnessed a Target loss prevention associate "brutally detain, wrestle, strike and choke a shopper for more than three minutes."

Target Tries to Screw Customer - Picked on Wrong Guy

I keep telling folks how "Target Sucks" and every now and then I come across a story about how some consumer or employee got totally screwed by them.

Here is a link to another site where Tarbutt picked on the wrong guy to try to screw. It is titled: "How Target screwed me out of $425" and involves the TARGET Store #2248, 10720 SW Village Pkwy, Port St Lucie, FL 34987.

It is a bit to long to include here but take a look at the below link for details about this XBox purchase and what this consumer did to get the jerks at Tarbutt to finally see that they picked on the wrong guy.

The customer used a Debit card to pay, if you have to shop at Tarbutt at least pay with a credit card (V/MC/AMX) so if you have this sort of problem you can 'dispute' the charge with the card company. They will almost always take the consumers side in these disputes.

You have now - I have an automatic notification on google for certain key words, in todays list was a long craigslist item from a fired Target worker, I only put on a bit of it as it seems to support other info on other threads about people of long standing getting canned. Just to cut to the end of the post, it reports the ex-employee found other employment, so I guess it ended well after all, here is the 1st part FYI look at the whole post if this interests you:

Tarbutt is making a major company wide effort to eliminate FT employees in favor of minimum wage PTers. Long serving 'career' employees are discharged for bogus reasons.

The Tucson Weekly story a few posts down the blog is about a long serving employee getting let go for absurd made up reasons, who alleged in a civil suit that this was done to get rid of her so that other lower paid workers could be used thus saving the company money.

MINNEAPOLIS (AP) - Retailer Target Corp. has decided to cut some 85 marketing jobs, representing about 8 percent of its 1,100 employees in that department.

The move was part of Target's normal practice of evaluating all areas of the company to make sure they are effective, the company said in a statement Thursday.

The affected employees all are located at its headquarters in Minneapolis, where some 12,000 Target employees work, Target said.

Target has been cutting staff, tightening consumer credit card underwriting, and limiting inventory in the recession.

Although discount retailers have benefited from consumers switching to cheaper stores and focusing on necessities in the recession, Target has been hurting because much of its revenue comes from fashionable nonessentials like home decor and clothing.

Something to watch for out of a medium sized city in East Central Alabama: A local businessman who had items for sale on the internet had his business' pretty much ruined by the Tarbutt Corporation's AP Goon Squad who thought his offerings were their stolen merchandise.

Tarbutt being so 'in the bag' with law enforcement they had little problem getting local cops to spring into action. Problem was the guy didn't have anything in the internet offerings from his various pawn shops that was tied to Tarbutt. T. came up with nothing the businessman is now out several hundred thousands of dollars and has a damaged reputation and has been banned from further postings on the internet sales site. In coming weeks/months you can expect to see Tarbutt in court again.

Beckfords' Az. 'Charge of Discrimination'

Regular readers like to see 'new' posts, so I will put this Az. State complaint at the top for a few days then move it down the blog. Recently I have been concentrating on the Beckford suit in Az.

And just a few words of warning to you folks that look in from Target: When you reach the pay level where your employeer thinks it would be cheaper to replace you with a 'new' employee or when you get close to being able to 'retire', then you will probably find yourselves the victim of the Target stealth policy of writing you up for some bogus crap and firing you.

The favorite reasons seem to be: 1) leaving a door unlocked, 2) improper use/purchase of gift cards or 3) leaving money in a register at closing.

You folks who look in from HQ and the DC's are probably just skimming this blurb thinking that all this just applies to the folks out in the stores and that you have nothing to worry about.

On Tuesday, Jan. 27 2009, Target Corp. cut 9 percent of headquarters workforce, 1,000 positions were involved. No advance warning was given, employees were called into the HR office, discharged and escorted out of the building by Tarbutt Security. Reportedly they were not even allowed to return to their desks, they just 'disappeared'.

The cuts affected 9 percent of their workforce at headquarters locations. This included about 600 layoffs and eliminating 400 open positions primarily in the Twin Cities. The majority of these changes were effective 1/27/09.

Summary: Target is out for its own bottom line, they don't give a crap about you or how many years you worked there. If their bean counters think you make too much or you are to close to retirement then you are gone. Remember this: TARGET SUCKS!

“According to Manny Lovio, after 26 years with Target he was asked to quit. When he refused, he was fired. He was escorted to his desk to clean out his belongings and then guided out of the store in front of co-workers and customers.
. . . shortly after his dismissal, his best friend at the company, Lavonne Beckford, was also fired. And over the last five years, other longtime employees he knew from his early days at Target were also forced to quit or were fired. The former co-workers started meeting with each other and sharing their stories.

They say they began to notice a pattern. Their group, mostly hired in the '80s, had each been with the retail company for 20 years or more. Most of them were salaried executives, making more than $50,000 a year, sometimes even more. Besides the wages, the employees had full benefits, and most were eligible for up to five weeks of vacation. "They could hire two or three people at the price they were paying us," Lovio says.

According to a former Target manager . . . Lovio and his former co-workers are right. Target is all about image, so getting rid of older employees is a good way to make room for younger executives.

They look better, and the moves save money, he says. The manager worked for the company for 21 years with Beckford and Lovio. "Mostly, I saw that. . . as you got older and your pay increased, the feeling was that you were a problem," he says.

During management meetings, the long-time employees identified as problems were called "blockers," he says.

"It was understood that I could hire someone 10 years younger than these people, at half the pay, and they had college degrees. I'd sit during the management meetings, and we'd identify who is a 'blocker'—which meant they needed to leave the company," he says.

The former manager says layoffs or buyouts of long-time employees would have cost the company money, so instead, the corporation put pressure on the store managers.

"We were told to figure out how to get rid of these blockers that cost too much money," he said. José Garcia figures he was probably considered a blocker when he was fired from Target on Dec. 14, 2008, after working for the company for 21 years.

Lavonne Beckford, a former Target employee filed a discrimination lawsuit against the retail company in 2008.

When Target spokesperson Sarah Soriano was first contacted, she denied that Target was being sued for discrimination in Tucson, and said the company hadn't been served. However, Soriano called back later and said she misspoke, confirming Target is in the midst of a lawsuit filed by Beckford. "Unfortunately, I can't comment on any litigation or any of these specific allegations," Soriano says.

When asked if "blocker" is a word used by Target management to describe executive team leaders who've been identified as being with the company for too long, Soriano says it isn't a term used in Target corporate culture.”

Clifton Stephney was employed as an Executive Team Leader (“ETL”) of Logistics at the Target store in Bloomington, Indiana. Despite good to excellent performance reviews, Stephney was fired on November 17, 2006.

The decision was made by store manager Jennifer Mayer. Her stated reason was that Stephney was condoning off-the-clock work by an hourly employee. Stephney is a forty-two year old African-American who has now brought claims under Title VII of the Civil Rights Act of 1964, and the Age Discrimination in Employment Act.

Target has moved for summary judgment, arguing that Stephney’s off-the clock conversations with an hourly employee were its sole grounds for termination.

Its motion is denied. Stephney has come forth with sufficient evidence that Mayer and Target were attempting to eliminate older and African-American employees and that off-the-clock communications, despite written policies banning them, were widespread and part of the company culture.

The Record for Summary Judgment
Target complains that Stephney’s statement of material facts in dispute does not comply with Local Rule 56.1 and that his reliance on certain affidavit statements is inappropriate. . .. Target’s assertion that Stephney’s fact statements “misrepresent the evidence” is simply unfounded. Stephney is free to highlight the facts in a light most favorable to him.

Turning to the facts
Stephney was first employed by Target in 2002 as an ETL of Replenishment in California. He left Target in 2003. After relocating to Bloomington, he was hired again in December 2003 in the same position at a new store. In September 2005, he was promoted to ETL of Logistics. The ETL of Logistics is a salaried supervisory position that reports to the store manager. In this position, Stephney worked overnights. He was in charge of the merchandise stocking process, which occurs after hours when no customers are present.

Stephney’s performance reviews at the Bloomington store were all good to excellent. He was reviewed twice annually. His annual reviews for 2004 and 2005 were both “exceptional.” He also “met expectations,” the higher of two possible designations, on all of his mid-year reviews. He received his last mid-year review on October 9, 2006. The mid-year review stated: “Mr. Clifton [–] wow [–] what a outstanding growth year for you. You successfully took the logistics score to 100%, developed a solid team and have produced some outstanding results . . . I am proud of your accomplishment.”

Mayer became Stephney’s official supervisor on September 1, 2006. Both Mayer and Bontekoe are Caucasians. Mayer was born in 1973. The entire time Stephney was employed at the Bloomington Target, he was the only African-American ETL in Bloomington.

Target has hired one African-American ETL in Bloomington since Stephney’s termination.

After Mayer became store manager, she made Heronemus co-ETL of Logistics with Stephney.
Don Price, a Caucasian born in 1975, was later put in charge of the dayside Logistics staff, a responsibility previously held by Stephney. Both Stephney and Heronemus worked nights.

Stephney was formerly the only head of Logistics, but after Mayer’s appointment and Heronemus’ promotion, he began to feel that his instructions to Logistics team members were being undermined by Heronemus or Price. He complained about the lack of authority to Mayer, who told him that decisions should be made by majority rule among Stephney, Price, and Heronemus.

On November 1, 2006, Stephney complained to Mayer about Price and Heronemus
undermining his decisions. Mayer responded that they were younger and could relate to each other, while Stephney was older with a family and might not be able to relate to them.

Mayer’s reference to Stephney’s age on November 1, 2006 was not the first time the subject had come up in her short time as Stephney’s supervisor. Around the time that she took over as store manager, she saw a picture of Stephney’s family on his desk and asked how old he was. When he told her he was forty, she commented that he was older than she was. Although that last comment was obviously innocuous by itself, Mayer had also terminated Bobette Mucherheide, an employee over fifty years old whom Stephney had supervised. Mayer told
Stephney that Mucherheide was “too old and slow to be a team leader.”

Mayer also made a comment about race that is relevant here. In October 2006, Mayer asked Stephney what the word on the floor was about her. Stephney told her that team members were concerned Target was getting rid of minorities and older employees. Mayer responded that Target did not have to have minorities in leadership positions, merely in some capacity in the store.

Stephney was terminated on November 17, 2006. The official reason given was “Gross misconduct – condoning unauthorized work – knowingly permitting a team member to perform work off the clock, whether on or off company premises.”

Conclusion
Target’s motion for summary judgment is denied. The final pretrial conference remains set for March 6, 2009 with trial scheduled for March 16, 2009.

So Target's attempt to have the case tossed out was unsuccessful and it was ordered to trial. It was a trial that was never to take place:

Tarbutt knows a losing case when it stares them in the face, they also know what bad publicity is particularly when both Racial and Age Discrimination are involved. Hopefully Clifton Stephney is now living in a Chateau in Southern France and enjoying life. Good for you Clifton!

Target ETL Hiring Procedures

A 2006, 7th Circuit Court of Appeals case (Wisconsin): USEEOC v Target, gives a lot of interesting information on how Tarbut interviews and hires ETL applicants.

While this is a racial discrimination case that overturns and remands an earlier District Courts ruling that favored Target it is interesting in the details of the application process used by Tarbutt. It might be a bit long, at 27 pages, to read the entire case but the introduction at least is worth a look.

California Target Suit Needs More Plaintiffs for the Class Action Suit

An interesting Federal suit was filed in January of 2009 in California by 5 law firms who are taking on Target in a class action suit for a laundry list of improper work practices.

California attorney Richard Quintilone, of Lake Forest, Ca. (req@quintlaw.com) is looking for additional plaintiffs to join a 9 count class action suit against Target Corporation.

Mr. Quintilone tells me that he is seeking to contact: "Any California current or former Target employees or managers who worked for Target in California at any time up to 4 years prior to the filing of the case and who were denied meal and rest breaks, overtime pay, or forced to sign punch correction form in lieu of getting the one hour of pay owed (or face punishment and/or termination) or were forced to buy Target uniforms and failed to receive reimbursement."

Mr. Quintilone's firm is also handling the civil suit of a former California employee Jason Van Horn, who the Target AP thugs kept prisoner for over 6 hours, at the Orange County store, until he finally was compelled to sign an 'admission' of wrong doing for ringing up 3 $25 gift cards for personal purchase, which he had been authorized to do by a manager. He was arrested but the case was tossed out and now the former employee is suing.

California Suit claims Target dumped hazardous waste

I don't see any signs that the other Attorney Generals are moving on the problem but if California wins then perhaps it will wake up the rest of the country and some action will be taken. It really seems like a Federal violation that the EPA should be addressing, rather than 50 individual states.

Almost every day we have drop ins from HQ, their dedicated ISPs show up on our site meters so we know how long they are 'on' and what they looked at or downloaded. We don't mind a bit, however, just this month (last 3 days) they have been on 31 times and Wed. still has 3 hrs to go.

I guess it's nice to be popular, so since I have this hometown audience I want to mention again that I am always looking for nice confidential documents so I can post them. The Emails have been sent by HQ -

The emails have been sent out company wide by HQ to ETL-HRs and 8,000 full-time specialists and team leaders will be demoted to part-time.

Target is now eliminating the Specialist and Team Lead positions at its stores. This means downgrading 8,000 full time employees to part-time status of 32 hours and below thus getting them off full time benefits and hopefully off the payroll entirely.

2-3 Team Members per store will be trained up to Specialist duties and they will take over those duties while initially working along side the now demoted Specialists. So the current specialists will become part time and will "share" the department with other trained TMs with a large savings in hourly pay for Tarbutt.

The hope is that the now demoted Specialists will quit without being fired and having quit they will not be able to collect any unemployment pay. This ploy is a great savings in wages as the newly trained TMs hourly rates are lower than those employees they will replace.

Tarbutt has always had a policy of getting rid of full time workers who manage to hang on long enough to make any decent hourly pay and benefits, they first cut hours of the longer employeed workers and hire new employees at full time and lower hourly pay. If this dosen't get the hire paid workers to quit then they cut hours again and eventually the longer serving workers find themselves working 8 hours a week and they finally quit in disgust.

Of course Target needs a union but anyone who is heard to speak the word 'union' is out the door within hours.

With sales tanking, Tarbutt looks for something new

Target has been hit hard in the economic slump, and it is revamping 340 old stores at a $1 billion dollar cost opening only 10 new ones this year. They will redo 300 to 400 stores per year.

You will see the new store format starting in April and they will feature spruced up home furnishing offerings, larger grocery sections, better video game displays and shelf lighting in the beauty section. It is changing every part of its stores to increase sales and grab market share from rivals even testing out bulk sales in some stores to try and compete with the lower prices found at Wal Mart/Sams Club stores. Employee moral in these stores seems to have droped as the company edges towards the sloppy look found in the low cost discount stores.

Key in the renovations will be the enhanced grocery sections, they hope will bring shoppers in more often. Target introduced perishable items like bananas and lettuce in about 100 of its general merchandise stores last year. They now have 250 of the Super Target stores.

It costs $1 million to add the new PFresh food format to an existing general-merchandise store. That compares with $10 million to convert such a store to a Super Target. The PFresh concept combines fresh food like produce and meat with grocery items.

Target, and Wal Mart are both looking into opening smaller stores in large cities and in coming years Target plans to open stores in Canada and Mexico.

$7 Million Record-Setting Settlement for Woman Injured at Target

In this case of a 10/7/09 settlement, Mrs Putman was awarded the $7,000,000 because on June 21, 2007, Mrs. Putman was entering the Target store located at 7000 Mannheim Road in Rosemont, Illinois, as she walked through the entrance, the door malfunctioned and closed before she successfully maneuvered through the entry. Mrs. Putman, a slight woman, was knocked over and hit her head when she fell to the ground. Her head was hit a second time by the door when it continued to open and close.

One Year Ago: Tarbut HQ Massacre

On Tuesday, Jan. 27 2009, Target Corp. cut 9 percent of headquarters workforce, 1,000 positions were involved. No advance warning was given, employees were called into the HR office, discharged and escorted out of the building by Tarbutt Security. Reportedly they were not even allowed to return to their desks, they just 'disappeared'.

The cuts affected 9 percent of their workforce at headquarters locations. This included about 600 layoffs and eliminating 400 open positions primarily in the Twin Cities. The majority of these changes were effective 1/27/09.

Target also closed its Little Rock, Ark. distribution center. The center employeed 500 people.

Since the item is defective and they still sell the product with slightly different packaging this is real easy. Go to a different Tarbutt store and buy a brand new one of the same item you already have, use a charge card (not a debit card), wait a few days and take the 'old' non working item back with the 'new' packaging and the receipt. Just tell them you are returning the broken item as it doesn't work. You get a refund on your card for the broken one and you keep the 'new one' for yourself.

More details emerge on Target's probe of immigrant workers

A lot going on with Tarbutt out on the left coast these days, civil suits, state fines and now mass firings - A summary of the second Matt O'Brien article in the Contra Costa Times (Walnut Creek) shows that Tarbutt is taking a strict approach to the Obama administrations intent to enforce immigration laws.

With complaints about Targets Walnut Creek store using a large number of illegal immigrants on the night shift a compliance team was sent out from the Minneapolis corporate headquarters resulting with a confusing account of whether the employees quit or were terminated for lack of I-9 compliance.

The message seems to be that if you want to get rid of illegal workers you need to drop a dime on them to corporate and let HQ know problems exist at certain stores.

The long article says in part: "By the end of the second week of November, 50 Latino employees — at least half of whom say they were given no warning of what was coming — were out of their jobs. It was not a layoff, Target said last week.

Nor did the 50 employees quit, said Rocio Avila of the San Francisco-based legal advocacy group La Raza Centro Legal, which has intervened on their behalf.

But whether the Latino workers were fired, or were otherwise compelled to leave on their own because they did not have the proper documents, remains a point of contention. Target says the store questioned some workers in mid-November about their eligibility to work in the United States, prompting most of those workers to voluntarily resign. It will not say any more than that."

"I had benefits. I had my work permit," said one Bay Point resident who worked at the store for several years. "I hoped to work there for a long time."

Area reactions show support for the terminations: ". . . local observers have celebrated Target's actions as a move in the right direction and a sign that more employers will take illegal immigration more seriously."

In the papers extensive online 'comments' section reader Ian sums it up when he posted: "I'm pretty sure the problem here is that they were not hiring Americans first in this recession. They are now simply trying to save face. They never should have put themselves in this position in the first place."

"I Stopped A Nosey Target Clerk From Scanning My License"

is the headline on a www.consumerist.com article today. For those who don't know about the site you might want to drop in and take a look, it is a site owned by Consumer Reports and this particular article raised the question regarding why a pharmacy clerk needed to scan the 'guests' drivers license which has a lot of encoded information on it that a retail store has no business having.

The poster said in part:
"I don't want Target to keep my personal information in their database - I couldn't find any info regarding what info is kept, for how long, or how secure it is. But it looks like giving a birthdate works instead and makes me feel like my privacy is more secure."

Is Tarbutt now part of Homeland Security? What happens to this scanned information? How long is it kept? Who has access to it? One poster noted that some states include social security numbers on the magnetic strips. There are a lot of questions about this policy, and it is particularly troublesome when you consider that Target HQ brags about its cooperation with the FBI and other law enforcement agencies.

In a seven-week promotion called "The Great Save," Tarbutt is using areas of the store that were once used for seasonal merchandise to pile up pallets of detergent, paper towels, bottled water etc. in an attempt to compete with the warehouse clubs and Wally World.

Tarbutts profits have taken a nose dive during the recession and this latest test program is aimed at convincing ‘guests’ that there are savings at Tarbutt of the sort they find in the Jill and Joe Sixpack sort of stores.

"The idea is to create the fun, convenience and treasure-hunt feeling of a warehouse environment within your local Target store -- without the membership fees." Of course we all go shopping for 'fun' and 'treasure hunting', It remains to be seen if ‘guests’ will be impressed with such nonsense.

C3, is the Corporate Command Center, Control room technicians can check 75,000 store security cameras at any given time from their PCs from the third floor of Target Corp.'s downtown Minneapolis headquarters and keep tabs on anything that could disrupt operations at Target's 1,743 stores or worldwide offices.

While the Tarbutt publicity department is undoubtedly pleased with the report, the 'back story' on this should be that Target AP is looking in at their employees from HQ and they are not looking in to send them warm fuzzy greetings from Minneapolis.

Tarbutt AP at HQ are not looking for shoplifters, that is for the local AP to do, they are looking for any employees who are spending time goofing off, talking to other employees, violating company policies or just ducking and diving to get out of work.

Big Brother at HQ are looking in anytime there are employees in the store, the cameras are always 'live', not just during 'business hours'. They monitor everywhere in the store except the bathrooms and changing rooms. Just because you don't see one of the 'domes' does not mean you are not on camera, those domes are 50% empty anyway, and are there for shoplifting prevention.

Even before the stores open, from New York to Minnesota, Alaska to Hawaii, Target Corporate Control keeps tabs on them.

Target Corporate Headquarters in Minneapolis is keeping a close eye on Black Friday shoppers in their stores nationwide from their Mpls. Target 'Command Center'. They are being extra cautious after the tragedy last year at a Wal-Mart when a shopper died after customers stormed the doors.

WCCO-TV got a rare look inside Target's Corporate Command Center. "This control center is our 'NASA Mission Control,' it is the hub," said Target Corporate Vice President of Asset Protection Brad Brekke.

It's from there Target security staff keeps an eye on stores across the country, 24/7 and year-round. It's especially important on Black Friday weekend. "To ensure guest service by monitoring both crowd management outside and once our stores open, ensuring that the guests are able to move through the store OK," explained Brekke

Even before the stores open, from New York to Minnesota, Alaska to Hawaii, Target Corporate Control keeps tabs on them. "We want to ensure those that show up first keep their proper place in line. We don't want to create confusion or anger with the crowd itself," said Brekke.

So cart caravans are used to create an orderly flow both inside and out as groups of shoppers file in at a staggered pace. "And then make sure in the store itself that there's not running for the product," said Brekke.

The electronics department is the first stop for many. "Getting the door busters and finding deals," said Carla Anderson of Fridley. "I've got some video games, I've got some PS3 games, some Wii games."

Shoppers say the security measures worked. Target security had no major problems Friday at any of the stores across the country.

David Lawrinowicz of Lancaster had worked at Target for nearly eight years before the company fired him Wednesday — for buying two Zhu Zhu Pets.

Not stealing them, buying them. Lawrinowicz, who worked the overnight at the Cheektowaga location on Walden Avenue, helped unload a shipment of the hot holiday toy at the start of his shift around 11 p.m. Before leaving for the day at 5 a.m. the next morning, he and six other employees lined up to buy a few of the plush hamsters each. Overnight employees are allowed to make purchases during the company’s off hours.

None of the workers bought more than the limit of four Zhu Zhu Pets per customer. In fact, Lawrinowicz bought just two of them for his daughter Jessica. There were more hanging on the store’s racks when the employees cashed out.

A few days later, Lawrinowicz said he was called into the human resources office and told employees were not allowed to purchase “popular items” until the store opens at 8 a.m. There was no write-up, and he went back to finish his work.

Two weeks later, he and the other co-workers including his team leader were called in and fired by a choked-up, apologetic store manager. They were told the company’s policy about buying “two-day ad items” had been clearly posted in a sign over the employee time clock.

“There was no such thing. I look in that spot every day when I punch out and there was nothing there,” said Lawrinowicz.

He can’t help feeling his termination and that of his colleagues is overly harsh, especially right before the holidays. “I told them I would bring the things back. It’s not worth losing my job over. It’s an $8 toy,” he said. “But they said there was nothing they could do.”

Dec 22 Update: Target Rehires Zhu Zhu-Buying Employees

Target has rehired all seven employees who were fired for buying the season's hottest toy -- Zhu Zhu Pets -- during off-hours, according to a statement released this weekend.

After a review (we're guessing of both the store's actions and the public's very vocal response), Target released a statement saying they had "carefully reviewed the situation at the Walden Galleria Target store, and we have determined that the team member terminations were the unintended consequence of a good policy rigidly applied. Therefore, Target intends to reinstate all seven of the team members, effective immediately.

NOTE: If it had not been for massive bad publicity these folks would still be unemployeed!

2,100 Target India workers are having a happy Christmas this year, Targets Nov '09 news release insists that the rumors of closing their Bangalore operation are untrue (see below).

You might recall that in Jan of 2009 Tarbutt abruptly fired 600 HQ workers and 400 Distribution Center workers (see: http://targetfiling.blogspot.com/2009/01/target-corp-cuts-9-percent-of.html) Many were long term Target workers who were escorted out the door by security within minutes of being fired.

Job Description
Purpose: Target is looking for an individual with graphic design and flash skills to work with a collaborative project team. In this role you will work on projects for online training experiences to give team members knowledge or skills that are key to their success at Target. Working with a client team internal to Target, you will be responsible for the development process and deliverables.

PRIMARY FUNCTION:
Designs, develops, and creates graphic and multimedia project deliverables for the OE eLearning team.

Prepare illustrations or rough sketches of material, discussing them with clients and/or supervisors and making necessary changes. Produce still and animated graphics for eLearning projects. Create designs, concepts, and sample layouts based on knowledge of layout principles and esthetic design concepts. Use Adobe software product suite to generate new images. Draw and print charts, graphs, illustrations, and other artwork, using computer. Review final layouts and suggest improvements as needed. Job Requirements Minimum Requirements:

Orange County Calif Target AP Thugs are at it again!

In a 5 count, 19 page Complaint filed 04/03/2009, Jason Van Horn, a former cashier at an Orange County, Calif. Tarbutt store complains that he was held for over six hours by Tarbutt AP team members Raphael Guzman ETL, and Jesus D Nunez with the approval of their supervisor Benjamin Atkinson.

The complaint states how he was repeatedly threatend over his earlier issuance of 3 $25 gift cards. Van Horn stated that the transaction was authorized by store manager Mike Spencer and asked them to contact Spencer to verify this.

Guzman and Nunez ignored Van Horns various requests to verify his story and his many requests to leave the small office where he was held.

He was told that 'the only way he would leave was in an ambulance.' A statement was eventually signed by Van Horn, the S.O. was called and van Horn was cited for Embezzlement, later this changed to Petty Theft and on 9-14-07 Judge Sanders "discharged Plaintiff as to the criminal complaint."

The case is in U.S. District Court, Central Dist of Calif (8:09-cv-00406-JVS-MLG) The lawyers for Van Horn have been stonewalled in getting access to documents, this is a typical Tarbutt delay practice as we have seen from other cases reported here. They also as a matter of routine appeal any loss, thus dragging these cases out for many years.
